By accessing or purchasing from this website, you agree to comply with and be bound by the following Terms of Service. If you do not agree with any part of these terms, please refrain from using the site.

1. Intellectual Property & Copyright Notice

  • Artist Ownership: All content on this website (including text, images, graphics, logos, and artwork descriptions) and all original artworks sold remain the sole intellectual property of the studio and artist.

  • Reproduction Rights: The purchase of an original artwork does not transfer copyright or reproduction rights to the buyer. Collectors may not reproduce, print, scan, distribute, or mint the artwork into NFTs or commercial products in any form without express written permission.

  • Social Sharing: Sharing photos or videos of your purchased artwork on personal social media accounts is always welcomed and does not breach this clause.

2. Website Use & Product Accuracy

  • Lawful Use: You agree to use this website only for lawful purposes and in a manner that does not harm, disrupt, or impair site performance or interfere with other users' access.

  • Product Descriptions & Display: We strive to represent the colors, dimensions, and texture of each original painting accurately. However, colors may vary between screens due to display calibrations; such variations do not constitute a product defect. We reserve the right to modify pricing or discontinue items without notice.

3. Shipping, Processing & Address Changes

  • Dispatch Times: Processing and dispatch timelines are provided within product descriptions. Dispatch times may be extended during peak sales periods or product launches.

  • Shipping Address Accuracy: Buyers are responsible for providing accurate delivery details. Address change requests must be submitted within 24 hours of purchase. Once dispatched, address changes cannot be made.

  • Undeliverable Parcels & Restocking Fees: If a parcel is returned due to an incorrect/incomplete address or failure to collect, the buyer is responsible for reshipping fees. If the order is cancelled after being returned, any refund issued will exclude original shipping costs and may be subject to a 20% restocking fee to cover administrative expenses.

4. Returns, Damage & Liability

  • Original Sales Final: All sales of original artworks are final. We do not offer returns or refunds for change of mind. Please note that colors may vary slightly across different device screens.

  • Collector Handling: The studio is not liable for damage or deterioration that occurs once the artwork is in the possession of the buyer due to improper handling, hanging, or framing.

  • Transit Damage Claims: Original shipments are insured. If your artwork arrives damaged in transit, you must contact the studio within 48 hours of delivery with photos of both the damaged outer packaging and the canvas.

 

5. International Customs, Duties & Taxes

  • Import Fees: International orders ship from Western Australia. Destination import taxes, VAT, duties, or local customs charges are not included in the checkout total and remain the sole responsibility of the customer.

  • Refused Deliveries: If a parcel is refused or returned due to unpaid customs duties, a refund will be issued for the purchase price minus all round-trip shipping expenses once the artwork is returned in original condition. Customs values will not be falsified on export declarations.

6. European Union (EU) "Cooling-Off" Period

In accordance with EU consumer protection laws, customers residing within the European Union may withdraw from their purchase within 14 days of receiving the artwork, subject to the following conditions:

  • Exclusions: The right of withdrawal does not apply to bespoke, custom, or commissioned artworks.

  • Return Expenses: The customer is solely responsible for all return shipping, packaging, insurance, customs duties, and taxes. Return shipping costs are not reimbursed.

  • Condition & Diminished Value: Returned artworks must be received in original, pristine, and saleable condition. Any evidence of damage, wear, creasing, tears, or handling beyond what is necessary to establish the nature of the piece will result in a denied return or deduction from the refund.

7. Liability, Returns & Transit Claims

  • Collector Handling Liability: We are not liable for damage occurring after delivery due to customer mishandling, improper hanging, framing, or exposure to environmental factors.

  • Consumer Guarantees: As guaranteed under Australian Consumer Law, compensation or remedies are provided if an item is faulty, damaged in transit, or fails to meet legal guarantees. Original art sales are final for change of mind.

  • Transit Damage Claims: All shipments include transit insurance. If your artwork arrives damaged, you must contact the studio within 48 hours of delivery with clear photos of the damaged outer packaging and the canvas surface.

  • Order Verification: All parcels include a packing invoice. Customers requesting investigation into missing or damaged items may be required to provide photographs of the packing invoice and all contents received. Complimentary items or studio gifts carry no monetary value and are not covered by refund obligations.

8. Limitation of Liability, Indemnification & Governing Law

  • Limitation of Liability: To the maximum extent permitted by law, the studio and its representatives shall not be liable for direct, indirect, or consequential damages arising out of your use of this website or purchased goods.

  • Indemnification: You agree to indemnify and hold harmless the studio from any claims, damages, or costs arising out of your breach of these terms or misuse of the website.

  • Governing Law: These Terms of Service are governed by and construed in accordance with the laws of Western Australia, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Western Australia.
